Terms & Conditions
1. GENERAL TERMS
These general terms and conditions apply to all legal relationships between the photographer and the client, as well as to all quotations, offers and agreements. The photographer may amend these terms and conditions at any time and without prior notice. It is the responsibility of the counterparty to review the terms that are in effect at the time of placing an order, additional order, or modification of an existing order. Provisions or conditions set by the client that deviate from, or do not appear in, these general terms and conditions are only binding for the photographer if and insofar as they have been expressly accepted in writing by the photographer. These terms and conditions are governed by Belgian law.
2. PRICES
Prices may be adjusted at any time. The revised prices apply to all orders and additional orders placed after the modification has taken effect. If the cost of materials for a product or sub-product has increased by more than 25% since the booking, the price increase will be communicated to the client, who may then decide whether to accept the product or sub-product under the new terms or to cancel the order. If the photographer has incurred additional costs and/or has carried out additional work that was reasonably necessary, the photographer will charge this to the client.
3. GIFT VOUCHERS
Gift vouchers are valid for one year from the date of issue. After this date, the voucher may only be used with the explicit approval of the photographer, and any updated prices will apply. If the voucher does not mention an amount but describes a service instead, the user must pay any price difference if the same service is more expensive at the time of redemption. Any remaining balance on the voucher (for example, if the voucher is redeemed for a cheaper type of photoshoot than stated) will not be refunded.
4. PAYMENT PERIOD
Invoices issued by the photographer are payable within fourteen days from the invoice date. Any invoice not paid by the due date will incur late payment interest of 10% per month, automatically and without formal notice. In the event of non-payment, reminder fees, formal demand costs and collection costs will be charged. All courts in our judicial district have jurisdiction.
5. RIGHT OF REFUSAL
The photographer reserves the right to refuse an assignment if new information becomes available after acceptance that makes execution unacceptable for the photographer.
6. POSTPONEMENT
The client may postpone their booking once, without additional cost, for a maximum of 30 days while retaining the original prices and terms that were valid at the time of the booking (subject to the availability of the photographer on the new date). If the booking is postponed for more than 30 days, the client can no longer rely on the original prices and terms. The most recent prices and terms will then apply. In case of illness, accident or force majeure, the photographer has the right to reschedule or cancel the assignment.
7. COLLECTION
Products/photos can be collected free of charge at the business location of the photographer. Delivery at the client’s address or shipment by mail or courier will be charged to the client. The photographer is not responsible for damage caused during shipment.
8. COMPLAINTS
All formal complaints regarding the delivery and/or performance of services must be submitted by registered mail within eight days of completion or invoice date.
9. LIABILITY
The photographer is not liable for any damage to the client unless caused by intent or gross negligence by the photographer or their representatives. Under no circumstances can the photographer be held liable for indirect damages resulting from use or performance of the services, such as loss of profits or loss of data. In the event of direct damage, the liability of the photographer is limited to the amount paid by the client for the service that caused the damage. The photographer cannot be held liable for physical or material damage caused by falling, slipping, etc. during the photoshoot. The photographer cannot be held liable for the loss and/or damage of the client’s personal belongings before, during or after the photoshoot.
GENERAL
1. PUBLICATION BY THE PHOTOGRAPHER
Images created by AMBRA DENECKERE may be published at any time on the photographer’s website, Facebook and Instagram. The photographer may also use the images for promotional purposes and publications including, but not limited to: portfolio, advertisements, social media, magazine articles, competitions, printed materials, exhibition materials and photographic print sales. The photographer respects GDPR. Personal client data is used only for administrative and communication purposes.
2. PUBLICATION BY THE CLIENT
Images created by AMBRA DENECKERE may be shared by the client on social media, websites and for printed materials for their own shop/brand. The client must always include the following credit:

3. COPYRIGHT
All assignments/photoshoots by AMBRA DENECKERE are artistic work and are therefore protected by copyright. The photographs remain the property of the photographer. Upon full payment of the session and files, the client obtains the right to print and publish the photos for personal or business use. Unless expressly agreed in writing, any reproduction, publication (including print in newspapers or magazines), exhibition or any other use is only permitted with prior written consent from the photographer. In case of copyright infringement, the photographer will charge three times the usual licensing fee as compensation for the damage suffered. Payment of damages does not grant the right to continued use of the photographer’s work. All copyright and intellectual property rights of any production created by AMBRA DENECKERE remain the property of AMBRA DENECKERE, unless agreed otherwise in writing.
4. USE OF PHOTOS
All photos created by AMBRA DENECKERE may be used by the client for one year (starting from the invoice date). After this period, usage may be renegotiated, and a revised fee may be charged.
5. EDITING
The photographer delivers images in her usual editing style, applying global optimisation of light, colour, contrast, crop and other adjustments at her own discretion. Additional editing beyond this is only possible after consultation and may incur extra charges.
6. STORAGE
Images created based on an invoice or TFP/TFCD collaboration are stored for a minimum of 60 days after the session date. In the event of force majeure resulting in data loss (including memory card failure, camera/equipment malfunction or data crash), the photographer cannot be held liable.
7. COLOUR
The photographer is not responsible for colour deviations on non-calibrated screens or for prints not produced by the photographer.
DEPOSIT
1. CONFIRMATION OF BOOKING
By paying the stated deposit, the client officially confirms the booking of the planned photoshoot. This payment constitutes a binding confirmation of the agreed date, time and location.
2. DEPOSIT TERMS
The deposit fee stated on the invoice is due at the time of booking. The deposit serves as a guarantee for the reserved date and the availability of the photographer’s services. The deposit will be deducted from the final invoice.
3. CANCELLATION
If the client decides to cancel the booked photoshoot, the deposit will not be refunded. This applies regardless of the reason for cancellation, including scheduling changes, location changes or personal circumstances.
4. RESCHEDULING
If the client wishes to reschedule the photoshoot to another date, this is possible subject to the photographer’s availability. The deposit may be transferred to the new date, provided that the request is made at least [number of days] prior to the original date of the photoshoot.
5. FULL PAYMENT
The remaining balance, after deduction of the deposit, must be paid before or on the day of the scheduled photoshoot. If timely payment is not received, the photographer reserves the right to cancel the session and retain the deposit.
By paying the deposit, the client acknowledges that he/she has read, understood and agreed to these terms and conditions. We appreciate your trust in our services and look forward to creating an unforgettable photographic experience for you.
